preloved.supply Terms of Use

1.1. By accessing or using preloved.supply, you agree to these Terms and our Privacy Policy. 1.2. If you do not agree to these Terms, you must not use the platform. 1.3. These Terms constitute a legally binding agreement between you and ITTO OÜ, operating as preloved.supply.

2.1. preloved.supply is a platform that enables: - Inventory management for fashion resellers - AI-powered product cataloging - Sales facilitation through card payments and bank transfer (SEPA) - Point of Sale (POS) functionality 2.2. The platform is designed for individual fashion resellers ("Sellers") importing small batches of products.

3.1. To create an account, you must: a) Be at least 18 years of age; b) Provide a valid email address; c) Accept these Terms and our Privacy Policy; d) Have legal capacity to enter into binding agreements under applicable EU member state law. 3.2. You are responsible for: a) Maintaining the confidentiality of your account credentials; b) All activities that occur under your account; c) Notifying us immediately of any unauthorized use. 3.3. One account per person is permitted.

4.1. You agree to: a) Provide accurate and complete information; b) Use the platform only for lawful purposes; c) Comply with all applicable laws and regulations, including EU and member state legislation; d) Respect the intellectual property rights of others; e) Not interfere with the platform's operation. 4.2. You are solely responsible for: a) Products you list and sell; b) Accuracy of product descriptions; c) Compliance with the EU Consumer Rights Directive (2011/83/EU) and applicable member state consumer protection laws; d) Tax obligations related to your sales, including VAT.

5.1. You may NOT: a) Use the platform for illegal activities; b) Sell prohibited or counterfeit items; c) Misrepresent your identity; d) Attempt to access other users' accounts; e) Interfere with platform security; f) Scrape or harvest user data; g) Use automated systems without authorization. 5.2. Violation may result in immediate account termination.

6.1. The preloved.supply name, logo, and platform software are protected by intellectual property laws, including EU Directive 2001/29/EC on copyright and related rights. 6.2. You retain ownership of content you upload (photos, descriptions). 6.3. By uploading content, you grant us a worldwide, non-exclusive, royalty-free licence to host, reproduce, adapt the size of and display that content in order to operate the Platform and to promote your listings. This includes displaying your listings and their photos on third-party commerce, search and advertising surfaces (for example a Meta, Google or comparable product catalogue) and in paid advertising that we fund, in each case to promote the listing itself. 6.4. That licence lasts only as long as we need it to provide the service. It ends for a listing when you delete or unlist it, except that copies already sent to a third-party surface may persist until that surface refreshes its own catalogue, and we may keep records the law requires or that a dispute needs. You may ask us to exclude your listings from third-party advertising surfaces at any time by contacting us; doing so does not limit your ability to sell on the Platform.

7.1. The platform is provided "as is" without warranties of any kind, to the extent permitted by applicable EU and member state law. 7.2. We are NOT liable for: a) Losses from platform downtime; b) Actions of other users; c) Third-party services (payment processors, etc.); d) Data loss beyond reasonable backup efforts. 7.3. Our liability is limited to fees paid in the relevant transaction. Nothing in these Terms excludes or limits liability for matters that cannot be excluded or limited under applicable EU law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

8.1. You may close your account at any time via Settings. 8.2. We may suspend or terminate your account for: a) Violation of these Terms; b) Fraudulent activity; c) Extended inactivity (12+ months); d) Legal or regulatory requirements. 8.3. Upon termination, your data will be handled according to our Privacy Policy and in compliance with the General Data Protection Regulation (GDPR).

9.1. We may update these Terms at any time. 9.2. Material changes will be communicated via email or platform notification, with 30 days advance notice. 9.3. Continued use after changes constitutes acceptance.

10.1. These Terms are governed by the laws of the Republic of Estonia. 10.2. Harju County Court in Tallinn, Estonia is elected as the court of first instance for any disputes. 10.3. Consumer rights under EU law, including the EU Consumer Rights Directive (2011/83/EU) and applicable member state consumer protection legislation, are preserved. Nothing in these Terms limits your rights as a consumer under the mandatory consumer protection laws of your country of residence.
